Civil and Administrative Law

In the U.S., civil laws and administrative regulations are key aspects of our legal and regulatory environment. Civil law generally addresses actions brought by private parties seeking to enforce their rights and pursuing monetary damages and/or equitable relief, such as injunctions. Administrative law deals primarily with government enactment or enforcement of its regulations and legal disputes involving the application of government regulatory codes.

Real Estate

The use and regulation of property for public and private purposes intertwine issues of civil and administrative law. Government regulation may limit private and public uses of property as well as protect the general public from environmental abuses. In addition, the landlord tenant relationship is regulated to protect the rights and interests of both parties. Legal Studies offers courses in Property & Real Estate Law (PLA 3610), Landlord and Tenant Law (PLA 4585), and Land Use and Environmental Law (PLA 4631) to address these legal concerns.

Litigation

Actions in civil courts, known as litigation, may occur in a wide range of substantive legal matters, including disputes concerning personal injury and property damage (torts), contracts, business organizations, real estate, consumer rights, and estates and trusts. Legal Studies prepares students for opportunities to aid attorneys involved with diverse civil matters through courses such as, Legal Research and Writing (PLA3104/3155), Civil Practice & Procedure (PLA 3201), Evidence (PLA 4263), and Law and the Legal System (PLA 3013).

Regulation

Administrative law plays a key role in government regulation of industry practices and business conduct as well as the protection of individual and public rights. Government regulatory codes impact such areas as commercial contracts, bankruptcy, business organizations, estate administration, and consumer rights. At times, administrative law disputes may initially be heard before an administrative law judge or panel before it can proceed into the civil courts. Some key courses taught in this area include: Administrative Law (PLA 4483), Florida Partnerships & Corporations (PLA 4433), Law of Contracts (PLA 4423), Estates & Trusts (PLA 4601) and Estate Administration (PLA 4602).
